These Terms of Service ("Terms") govern your access to and use of the FYTO mobile application, websites, cloud backup features, FYTO Assistant, support features, and related services (collectively, the "Services"). The Services are owned and operated by Techno Dynamics and Innovations, referred to as "FYTO", "we", "us", or "our".
By accessing or using FYTO, you confirm that you have read, understood, and agreed to these Terms and our Privacy Policy. If you do not agree, do not use the Services.
FYTO is intended for adults, especially parents and legal guardians who wish to record and review information relating to a child’s academic progress, hobbies, physical activity, screen-time habits, study planning, and related development indicators.
FYTO may provide features including:
Features may change, improve, be limited, or be discontinued over time. We may add, remove, or modify features for operational, security, legal, or business reasons.
You agree to:
FYTO may use account-bound local data protection to prevent one signed-in account from viewing another account’s local student data on the same device.
You are solely responsible for the child information, photos, academic data, activity data, and other content you add to FYTO. You confirm that you have appropriate authority and consent to provide, manage, back up, restore, and delete such information. You must not upload or store content that violates a child’s privacy, safety, dignity, or legal rights.
FYTO Assistant and other guidance features are provided for general informational and app-support purposes only. Assistant responses, academic indicators, consistency values, study plans, screen-time suggestions, career direction indicators, and similar outputs may be incomplete, approximate, or dependent on the data entered by you.
Some features, including FYTO Cloud Backup, may be available only through paid plans such as FYTO Plus. Plan price, duration, included features, and renewal terms will be shown in the app before purchase where applicable.
Payments may be processed by supported third-party payment providers such as Razorpay or other providers shown in the app. By making a payment, you agree to the applicable payment provider terms and any FYTO plan-specific terms displayed at the time of purchase.
Refunds, cancellations, failed payments, duplicate payments, and billing disputes will be handled in accordance with applicable law, payment provider rules, and any refund policy or support process published by FYTO. For billing support, contact support@fytoapp.com.
FYTO Cloud Backup is designed to help users restore selected FYTO data after app uninstall, device loss, factory reset, or device change. Cloud Backup may include parent profile data, student profiles, marks, academic history, study plans, hobbies, exercise records, screen-time records, app preferences, and uploaded photos.
Cloud Backup is a convenience feature and not a guaranteed permanent archive. Backups may fail due to network issues, authentication failure, storage limits, service interruption, user error, payment or subscription status, or other technical reasons. You should keep independent copies of any records that are critical to you.
You must not:
FYTO strictly prohibits content or use that endangers the physical, emotional, educational, or privacy interests of minors. Prohibited content includes sexualized content involving minors, dangerous acts involving minors, cyberbullying, harassment, non-consensual recordings, disclosure of sensitive personal details, or any content that may put a child at risk. Report serious concerns to support@fytoapp.com and, where appropriate, to the relevant legal authority.
You retain ownership of the content and information you upload or enter into FYTO ("User Content"). By adding User Content, you grant FYTO a limited license to host, store, process, display, back up, restore, secure, troubleshoot, and improve the Services solely for operating and supporting FYTO.
FYTO does not claim ownership over your child’s photos, records, or academic data. FYTO will not use child photos or child-specific User Content for advertising or public promotion without separate explicit permission.
FYTO, including its software, design, logos, content, features, text, graphics, and related intellectual property, belongs to Techno Dynamics and Innovations or its licensors. You may not copy, reproduce, modify, distribute, sell, or create derivative works from FYTO except as allowed by these Terms or with our written permission.
Our collection and use of personal data is described in the FYTO Privacy Policy. By using FYTO, you agree that we may process personal data as described in that Policy.
FYTO may rely on third-party services such as Firebase, Google Sign-In, Firebase Cloud Messaging, Firebase Storage/Firestore, Razorpay, Google Play services, and backend service providers. Third-party services may have their own terms and privacy policies. FYTO is not responsible for third-party services except to the extent required by law.
You may request deletion of your FYTO account and associated data from within the app where available or by contacting support@fytoapp.com from your registered email address. We may verify your identity before processing deletion requests.
We may suspend or terminate access to FYTO if you violate these Terms, misuse the Services, create risk to children or other users, fail to pay for paid features, or where required for legal, security, operational, or fraud-prevention reasons.
FYTO is provided on an "as is" and "as available" basis. We try to maintain reliable operation, but we do not guarantee uninterrupted, error-free, or fully secure service. Features may depend on device compatibility, operating system version, internet connectivity, third-party services, payment status, and user-entered data.
To the maximum extent permitted by law, FYTO disclaims warranties of accuracy, fitness for a particular purpose, non-infringement, uninterrupted availability, and error-free operation. You are responsible for decisions made using FYTO outputs, reports, suggestions, or assistant responses.
To the maximum extent permitted by law, FYTO and Techno Dynamics and Innovations shall not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of data, loss of profits, loss of goodwill, or interruption of business or personal plans. Where liability cannot be excluded, our total liability will be limited to the amount paid by you to FYTO for the relevant paid service during the twelve months preceding the claim, or INR 1,000, whichever is lower, unless a different limit is required by law.
You agree to indemnify and hold harmless FYTO and Techno Dynamics and Innovations from claims, losses, damages, liabilities, and expenses arising from your misuse of the Services, violation of these Terms, unlawful User Content, or lack of required authority or consent for child data or uploaded content.
We may update these Terms from time to time. We will update the "Last Updated" date and may notify you of material changes by email, push notification, in-app notice, or other appropriate method. Continued use of FYTO after updated Terms become effective means you accept the updated Terms.
These Terms are governed by the laws of India. The parties will first attempt to resolve disputes amicably by contacting support@fytoapp.com. If a dispute is not resolved amicably, it may be referred to arbitration under the Arbitration and Conciliation Act, 1996. The seat and venue of arbitration shall be Manjeri, Malappuram District, Kerala, India, unless applicable law requires otherwise. Courts with appropriate jurisdiction in Kerala, India shall have jurisdiction for court proceedings, subject to applicable law.
